Photographic / Digital Media Commissioning Terms

These terms were update on 07/03/2024. It is agreed that the terms set out in this document is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Special Requests / Coverage

The client understands and accepts that the photographic coverage will be as the photographers professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client's wishes.

When instruction for mast services is requested there may be certain limitations the viewpoints that can be achieved. A suitable survey should be carried out to ensure the mast services can be used. Situations may occur which can prohibit the use of the mast such as wind speed, vehicle or tripod position and the proximity of electrical cables. Although every effort is made to comply with the client's wishes it may not be possible to achieve the requested results.

Any special requests / instructions must be sent to the photographer in writing.

The Photographer

On occasions without notice it may be necessary for the photographer originally specified to be substituted by another photographer (e.g. due to ill health).

Images

All image sizes are nominal. The photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man made fibres. It is sometimes impossible to record the exact colour as seen by the human eye.

Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the act to copy or allow to be copied photographically / electronically or by any other means an image created as part of Lawrenson and Grebby Photography LLP services without the permission of the photographers in writing or email.

Any music track contained in videos supplied by us is subject to license agreements set out between Lawrenson and Grebby Photography LLP and the music providers. Music tracks used by Lawrenson and Grebby Photography LLP are licensed for online use. For any other use we would require an additional license to be agreed upon. This must be arranged in writing with us prior to video production.

All 360 degree tours supplied by us contain our licensed files from krpano. Third parties may NOT use our Licensed version of krpano to create new projects, including modified versions of our projects.

Hosting Services & Delivery of Work

We may provide digital download services for delivery of work (all media types). This service is provided by a third party. If you do not wish for a digital download delivery method there may be an additional cost for delivery. Please notify us at the time of booking services if you wish for an alternative method of delivery.

We may provide hosting for 360 degree tours, images and videos as part of an ongoing service to you. We can not guarantee that any hosted content will be accessible at all times or compatible with all devices and / or browser types.

Passwords for downloads are supplied via email for work delivered using our download service. Without this password you will be unable to download files. If you suspect un-authorised use of a password it should be reported to us and we can remove access to the download.

If you receive any files from us (as a download or on physical media such as a CD) and these files were sent in error, you agree to report this to us at post@lawrenson-grebby.co.uk and delete the files from your computer systems and / or securely dispose of the physical media (CD) which we supplied.

Artistic License

The photographer/s shall be granted complete artistic license including in relation to poses photographed and the locations used along with any necessary post production which is deemed necessary by the photographer on each image. The photographer/s judgemental regarding the locations/pose, post production and number of images taken shall be final. Due to the vagaries of the weather, environmental conditions and the willingness of subjects it may not be possible to capture all the images requested.

A PDF file containing post production information may be supplied with the final body of media. This PDF file may also specify any specific alterations to perticular image or media file.

Force Majeure or Act of God

The due performance of the services is subject to alteration or cancellation by either party owing to any cause beyond their control.

Display

The client hereby allows the photographer/s to display any images included as part of the services in their studios, portfolios, literature, web sites, exhibitions and advertising for self promotion and marketing. If images should not be used in this way please advise us when commissioning work.

Cancellation

The client may cancel the services at any time by giving written notice to the photographer/s but in doing so shall forfeit any monies already paid for work in progress or deposits.

Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party will be liable for indirect or consequential loss.

Complaints

Any complaints should be raised by the client with the photographer/s, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.

Payment

We require invoice details before beginning any work including email contacts and company addresses.

Invoices must be paid within 30 days of the date of invoice (unless different payment terms have been specified when work is booked or shown on an invoice).

Email Confidentiality

Email which is sent to and from Lawrenson and Grebby Photography LLP will be scanned by a secure external spam and virus detection company. Email sent to individuals at Lawrenson and Grebby Photography LLP may also be read by other LLP members.
